Moral/legal dilemma.

    Because it is more of a misdemeanor than the lesser.

    Is it not the same as punching someone, cutting their lip - and punching someone causing brain damage?
    You'd be very unlikely to go to jail for cutting a lip, but....

    And that has happened - people get punched to the ground every weekend, with no other consequences. An unlucky few will hit their heads badly on the way down and - like you say - could suffer brain damage.

    Can you explain to me why - ethically - those who punched the 'unlucky' ones should receive a harsher penalty?

    The 'intention' was exactly the same - to thump someone. The actual 'act' was exactly the same - a punch thrown at the face.

    Only the result is different. And was unintended in each case.

    So, why?

    The answer is to not drive recklessly and not to punch people.
